{"id":10823,"date":"2018-09-08T16:59:48","date_gmt":"2018-09-08T15:59:48","guid":{"rendered":"https:\/\/endcorporalpunishment.org\/?p=10823"},"modified":"2019-08-02T13:02:19","modified_gmt":"2019-08-02T12:02:19","slug":"south-africas-draft-childrens-third-amendment-bill","status":"publish","type":"post","link":"https:\/\/endcorporalpunishment.org\/south-africas-draft-childrens-third-amendment-bill\/","title":{"rendered":"Global Initiative submits comments on South Africa&#8217;s draft Children\u2019s Third Amendment Bill"},"content":{"rendered":"<p>In July 2018, South Africa&#8217;s draft Children\u2019s Third Amendment Bill was <a href=\"https:\/\/pmg.org.za\/call-for-comment\/704\/\" target=\"_blank\" rel=\"noopener noreferrer\">published and opened for comment<\/a> by the Department of Social Development. The Bill proposes a number of amendments to the Children\u2019s Act, including repealing the common law defence of reasonable chastisement that allows parents and carers to lawfully subject children to corporal punishment. The Bill also prohibits cruel, inhuman or degrading treatment or punishment of children and recommends the adoption of programmes promoting positive discipline at home and in alternative care are available across the country.<\/p>\n<p>The Global Initiative <a href=\"https:\/\/endcorporalpunishment.org\/wp-content\/uploads\/GI-submission-Children-Third-Amendment-Bill-2018-09.pdf\">submitted comments on the Bill<\/a> before the 7 September deadline, which were endorsed by our national partners Save the Children South Africa, The Peace Centre and Sonke Gender Justice. Our submission welcomes the repeal of the \u201cmoderate and reasonable chastisement\u201d defence, but recommends that it is accompanied by the insertion of a statement which explicitly prohibits the use of corporal punishment in all settings.<\/p>\n<p>In 2007, a first amendment to the Children\u2019s Act was proposed. It included a clause prohibiting corporal punishment in the home.
