Il est maintenant primordial qu\u2019elle refl\u00e8te clairement cette intention.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Il a \u00e9t\u00e9 soulev\u00e9 fr\u00e9quemment que le but de la loi est de mettre la l\u00e9gislation fran\u00e7aise en conformit\u00e9 avec la Convention des Droits de l\u2019Enfant. Les crit\u00e8res utilis\u00e9s pour \u00e9tablir si une loi est abolitionniste sont enti\u00e8rement bas\u00e9s sur le droit international et le travail du Comit\u00e9 des Droits de l\u2019Enfant (voir <a href=\"https:\/\/tbinternet.ohchr.org\/_layouts\/treatybodyexternal\/Download.aspx?symbolno=CRC%2fC%2fGC%2f8&amp;Lang=en\">l\u2019Observation G\u00e9n\u00e9rale sur le sujet pour plus de d\u00e9tails<\/a>). Selon le Comit\u00e9, l\u2019interdiction est compl\u00e8te quand\u00a0:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12pt;\">Toutes les d\u00e9fenses et autorisations des ch\u00e2timents corporels sont abolies, et<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">La loi interdit explicitement tous les ch\u00e2timents corporels et autres punitions cruelles et d\u00e9gradantes.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\">En prenant en compte que la pr\u00e9c\u00e9dente version de la proposition de loi, adopt\u00e9e par la Commission, interdisait explicitement les ch\u00e2timents corporels\u00a0:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u00ab Les titulaires de l\u2019autorit\u00e9 parentale l\u2019exercent sans violence. Ils ne doivent pas user \u00e0 l\u2019encontre de l\u2019enfant de moyens tels que la violence physique, verbale ou psychologique, les ch\u00e2timents corporels ou l\u2019humiliation. \u00bb<\/em><\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Et que la version adopt\u00e9e \u00e0 l&#8217;Assembl\u00e9e Nationale est :<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u00ab L\u2019autorit\u00e9 parentale s\u2019exerce sans violences physiques ou psychologiques. \u00bb <\/em><\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Le fait que ce terme ait \u00e9t\u00e9 enlev\u00e9 semble envoyer le message que la proposition de loi ne cherche plus \u00e0 couvrir les ch\u00e2timents corporels. Bien que Maud Petit et Agn\u00e8s Buzyn aient fait r\u00e9f\u00e9rence aux violences \u00e9ducatives ordinaires et\/ou aux ch\u00e2timents corporels dans leurs discours introductifs, leur disparition de la proposition de loi semble causer confusion, ce qui a \u00e9t\u00e9 refl\u00e9t\u00e9 dans les d\u00e9bats \u00e0 l\u2019Assembl\u00e9e Nationale.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">En vue du droit de correction jurisprudentiel, il apparait strat\u00e9gique de passer une loi claire qui ne laisse aucun doute et ne permet l\u2019utilisation du droit de correction en aucun cas \u2013 puisque le but d\u2019une interdiction est d\u2019assurer que la loi prot\u00e8ge les enfants de toutes violences, de fa\u00e7on \u00e9gale aux adultes. La loi qui sera adopt\u00e9e d\u00e9finitivement devra obligatoirement envoyer un message clair que toutes les formes de violences, y compris tous les ch\u00e2timents corporels aussi l\u00e9gers soient-ils, sont d\u00e9sormais interdits.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">La proposition de loi doit maintenant \u00eatre port\u00e9e au Senat, o\u00f9 elle sera \u00e9galement d\u00e9battue.\u00a0Du fait de la confusion actuelle, la Global Initiative conseille que la proposition de loi soit revue afin d&#8217;interdire explicitement tous les ch\u00e2timents corporels, aussi l\u00e9gers soient-ils.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\">Pour plus d&#8217;informations, voir notre <a href=\"https:\/\/endcorporalpunishment.org\/reports-on-every-state-and-territory\/france\/\">rapport d\u00e9taill\u00e9 sur la France<\/a> (en anglais).<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><em>Updated 3 December 2018 to clarify current phrasing and status of the Bill<\/em><\/span><\/p>\n<p><span style=\"font-size: 12pt;\">The Global Initiative extends its thanks and congratulations to Maud Petit, for her relentless work and dedication to the cause, to Agn\u00e8s Buzyn for conveying the support of the French Government, and to all who have been working in France for years to further child protection.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">It is clear that the purpose of this Bill is to prohibit all corporal punishment of children and to abolish the right of correction. It is now essential that the Bill clearly reflects this intention.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">It has been raised frequently that the purpose of this Bill is to bring French legislation in line with the UN Convention on the Rights of the Child. The criteria used to establish whether a law prohibits are entirely based on international law and the work of the Committee on the Rights of the Child (see <a href=\"https:\/\/tbinternet.ohchr.org\/_layouts\/treatybodyexternal\/Download.aspx?symbolno=CRC%2fC%2fGC%2f8&amp;Lang=en\">General Comment No. 8 for more details<\/a>). According to the Committee, the ban is achieved when:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 12pt;\">All defenses and authorisations for corporal punishment are repealed, and<\/span><\/li>\n<li><span style=\"font-size: 12pt;\">The law explicitly prohibits all corporal punishment and other cruel and degrading punishment.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 12pt;\">Taking into account that the previous version of the Bill, adopted by the Parliamentary Committee, explicitly prohibited corporal punishment (unofficial translation):<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>&#8220;Persons with parental authority must exercise this authority without violence. They must not use against the child means such as physical, verbal or psychological violence, corporal punishment or humiliation.&#8221;<\/em><\/span><\/p>\n<p><span style=\"font-size: 12pt;\">And that the version adopted by the National Assembly is (unofficial translation):<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u00ab Parental authority is exercised without any physical or psychological violence. \u00bb<\/em><\/span><\/p>\n<p><span style=\"font-size: 12pt;\">The fact that this term has been removed from the Bill seems to send the message that the Bill no longer seeks to include corporal punishment. Although Maud Petit and Agn\u00e8s Buzin referred to \u201cordinary educational violences\u201d and \/ or corporal punishment in their introductory speeches, their disappearance from the Bill seems to cause confusion, which was reflected in the debates at the National Assembly.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">In light of the existing \u201cright of correction\u201d in jurisprudence, it appears strategic to enact a clear law that leaves no doubt and does not allow raising a \u201cright of correction\u201d in any case \u2013 since the purpose of a prohibition is to ensure that the law protects children from all violence, on an equal footing with adults.
