Une premi\u00e8re proposition de loi a \u00e9t\u00e9 <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.senat.fr\/leg\/ppl18-168.html\">adopt\u00e9e en novembre 2018<\/a><\/span> par la chambre basse du Parlement, l'Assembl\u00e9e nationale, et doit maintenant \u00eatre d\u00e9battue au S\u00e9nat. Cependant, jusqu'\u00e0 pr\u00e9sent, elle n'a pas encore \u00e9t\u00e9 mise \u00e0 l'ordre du jour du S\u00e9nat.<\/span><\/p><p><span style=\"font-size: 12pt;\">Une deuxi\u00e8me proposition de loi distincte visant \u00e0 interdire les ch\u00e2timents corporels inflig\u00e9s aux enfants a \u00e9t\u00e9 pr\u00e9sent\u00e9e \u00e0 la chambre haute \u2013 le S\u00e9nat \u2013 en janvier 2019. Dans sa r\u00e9daction originale, la proposition de loi pr\u00e9sent\u00e9e au S\u00e9nat modifiait l'article 371-1.2 du Code civil (ajout soulign\u00e9) :<\/span><\/p><p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u00ab\u00a0[L\u2019autorit\u00e9 parentale] appartient aux parents jusqu'\u00e0 la majorit\u00e9 ou l'\u00e9mancipation de l'enfant pour le prot\u00e9ger dans sa s\u00e9curit\u00e9, sa sant\u00e9 et sa moralit\u00e9, pour assurer son \u00e9ducation et permettre son d\u00e9veloppement, dans le respect d\u00fb \u00e0 sa personne <u>et \u00e0 l\u2019exclusion de tout traitement cruel, d\u00e9gradant ou humiliant, y compris tout recours aux punitions et ch\u00e2timents corporels.<\/u>\u00a0\u00bb<\/em><\/span><\/p><p><span style=\"font-size: 12pt;\">Apr\u00e8s son examen en commission le 20 f\u00e9vrier 2019, la proposition de loi a \u00e9t\u00e9 modifi\u00e9e pour supprimer le terme \u00ab punitions et ch\u00e2timents corporels \u00bb du texte. Elle ins\u00e8re maintenant un nouvel alin\u00e9a dans l'article 371-1 du Code civil, qui reprend le texte de la proposition de loi adopt\u00e9e \u00e0 l'Assembl\u00e9e nationale en novembre 2018 :<\/span><\/p><p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u00ab L\u2019autorit\u00e9 parentale s\u2019exerce sans violences physiques ou psychologiques. \u00bb<\/em><\/span><\/p><p><span style=\"font-size: 12pt;\">La proposition de loi telle qu'amend\u00e9e par la commission va maintenant faire l'objet d'un d\u00e9bat et d'un vote au S\u00e9nat le 6 mars 2019.<\/span><\/p><p><span style=\"font-size: 12pt;\">En amont de ce d\u00e9bat, des amendements ont \u00e9t\u00e9 introduits qui, s'ils \u00e9taient adopt\u00e9s le 6 mars, rendraient la proposition de loi pr\u00e9sent\u00e9e au S\u00e9nat identique \u00e0 celle adopt\u00e9e par l'Assembl\u00e9e nationale en novembre 2018. Nous croyons comprendre qu'un texte adopt\u00e9 dans des termes exactement identiques par les deux chambres, m\u00eame si dans le contexte de deux propositions de loi s\u00e9par\u00e9es, arriverait ainsi au terme du processus l\u00e9gislatif et serait transmis au Pr\u00e9sident de la R\u00e9publique pour ratification, sans autre possibilit\u00e9 d'amendement ou de discussion.<\/span><\/p><p><span style=\"font-size: 12pt;\">La Global Initiative r\u00e9it\u00e8re que, puisque la proposition de loi semble avoir pour objectif d\u2019interdire tous les ch\u00e2timents corporels inflig\u00e9s aux enfants, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/endcorporalpunishment.org\/france-proposition-de-loi-votee-a-lassemblee-nationale\/\">la loi devrait refl\u00e9ter ceci de mani\u00e8re claire et explicite<\/a><\/span>, comme l\u2019exige la Convention internationale des droits de l\u2019enfant. La d\u00e9cision de supprimer la r\u00e9f\u00e9rence explicite aux ch\u00e2timents corporels pourrait \u00eatre interpr\u00e9t\u00e9e comme diluant la loi.<\/span><\/p><p><span style=\"font-size: 12pt;\">Si la proposition de loi adopt\u00e9e par le S\u00e9nat le 6 mars est identique \u00e0 celle adopt\u00e9e par l\u2019Assembl\u00e9e nationale, sans r\u00e9f\u00e9rence explicite aux ch\u00e2timents corporels, le gouvernement devra alors pr\u00e9ciser clairement, par tous moyens y compris par des textes r\u00e9glementaires, des campagnes de sensibilisation ou autres communications, que l'esprit et le but de la loi est de prot\u00e9ger les enfants de toutes les formes de ch\u00e2timents corporels, tels que d\u00e9finis par la Convention internationale des droits de l\u2019enfant. A first Bill was <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.senat.fr\/leg\/ppl18-168.html\">adopted in November 2018<\/a><\/span> [link in French] by the lower house of Parliament \u2013 the National Assembly \u2013 and is due to be debated in the Senate. It has however so far failed to be put on the Senate agenda.<\/span><\/p><p><span style=\"font-size: 12pt;\">A second and separate Bill to prohibit corporal punishment of children was introduced in the upper house \u2013 the French Senate \u2013 in January 2019. In its original wording, the Senate Bill amended article 371-1(2) of the Civil Code to state (unofficial translation, addition underlined):<\/span><\/p><p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u201c[Parental authority] is vested in the parents until the majority or emancipation of the child in order to protect him\/her in his\/her security, health and morality, to ensure his\/her education and allow his\/her development, with all due respect owed to his\/her person<\/em> <em><u>and excluding any cruel, degrading or humiliating treatment, including any use of corporal punishment or chastisement<\/u><\/em>\u201d.<\/span><\/p><p><span style=\"font-size: 12pt;\">After examination in Committee on 20 February 2019, the Bill was amended to remove the term \u2018corporal punishment or chastisement\u2019 from the text. It now inserts a new paragraph to article 371-1 of the Civil Code which mirrors the text of the Bill adopted in the National Assembly in November 2018 (unofficial translation):<\/span><\/p><p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt;\"><em>\u201cParental authority is exercised without any physical or psychological violence.\u201d<\/em><\/span><\/p><p><span style=\"font-size: 12pt;\">The Bill as amended by the Committee is due to be debated and voted on in the Senate on 6 March 2019.<\/span><\/p><p><span style=\"font-size: 12pt;\">Amendments have been introduced ahead of this debate which, if they are adopted on 6 March, would make the Senate Bill fully identical to the Bill adopted by the National Assembly in November 2018. Our understanding is that a text adopted in the exact same terms by both chambers, even if two different Bills to begin with, would thus reach the end of the legislative process and be transmitted to the President for ratification without further opportunities for amendments or discussions.<\/span><\/p><p><span style=\"font-size: 12pt;\">The Global Initiative reiterates that, as the intent of the Bill seems to be to prohibit all corporal punishment of children, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/endcorporalpunishment.org\/france-proposition-de-loi-votee-a-lassemblee-nationale\/\">the law should clearly and explicitly reflect this<\/a><\/span>, as required under the UN Convention on the Rights of the Child.
