Article 1 of the Law on the prohibition of ordinary educational violence (<em>violences \u00e9ducatives ordinaires <\/em>or<em> VEO<\/em>, which is the French term for corporal punishment) amends article 371-1 of the Civil Code to state (unofficial translation, addition underlined):<\/span><\/p><blockquote><p><span style=\"font-size: 12pt;\"><em>Parental authority is a cluster of rights and duties whose finality is the interest of the child. <\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em>It is vested in the father and mother until the majority or emancipation of the child in order to protect him in his security, health and morality, to ensure his education and allow his development, with all due respect owed to his person. <\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em><u>Parental authority is exercised without any physical or psychological violence.<\/u><\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em>The parents shall make a child a party to decisions that concern him, according to his age and degree of maturity.\u201d<\/em><\/span><\/p><\/blockquote><p><span style=\"font-size: 12pt;\">The Law also makes provision for training for day care providers (<em>assistant<\/em>\u00b7<em>e<\/em>\u00b7<em>s maternel<\/em>\u00b7<em>le<\/em>\u00b7<em>s<\/em>) on the prevention of corporal punishment (article 2) and puts an obligation on the French Government to produce a report on the national prevalence and attitudes towards corporal punishment in order to evaluate the means necessary to strengthen awareness-raising campaigns, parenting support and training of professionals (article 3). The Global Initiative welcomes this obligation to plan for the implementation of the ban and the Government\u2019s stated commitment to include this issue in the national strategy on child protection, to be published later this summer.<\/span><\/p><p><span style=\"font-size: 12pt;\">The Law will now be sent to the President for ratification, which must be completed within 15 days. It must be noted that it could still be referred to the Constitutional Council to check compliance with the Constitution within this 15-day period, by the President, the Prime Minister, the President of either house of Parliament or by a group of 60 MPs or 60 Senators. More information on the Law can be found below.<\/span><\/p><p><span style=\"font-size: 12pt;\">This reform makes France the 56<sup>th<\/sup> state worldwide to prohibit all corporal punishment of children, following the recent prohibition achieved in Kosovo last week. Prior to reform, corporal punishment was not fully prohibited in the home, alternative care and day care settings. The Global Initiative welcomes this important development and extends our sincerest thanks and congratulations to all those who have been working tireless for several years towards this achievement. However, the Global Initiative is satisfied that the intention of the law as adopted is to prohibit all forms of corporal punishment of children:<\/span><\/p><ul><li><span style=\"font-size: 12pt;\">During the debates at the National Assembly back in November 2018, MP Maud Petit clarified after the Bill was amended to remove the term of 'corporal punishment' that \u201c<em>the reference to physical and psychological violence included all forms of corporal punishment and humiliations against children<\/em>\u201d (unofficial translation). In France, the term of ordinary educational violence (<em>violences \u00e9ducatives ordinaires<\/em>) is the most used translation of corporal punishment. Later declarations by members of the Government during debates at the National Assembly and at the Senate clearly confirmed this interpretation of the Law.<\/span><\/li><li><span style=\"font-size: 12pt;\">The explanatory memorandum of the Bill as introduced in October 2018 explicitly refers to corporal punishment and France\u2019s obligation to prohibit under international and regional human rights treaties, the research done on the harmful effects of corporal punishment, and the intention to abolish the 'right of correction' by amending the Civil Code. The title of the Law refers to the prohibition of ordinary educational violence.<\/span><\/li><li><span style=\"font-size: 12pt;\">The wider public discourse, including media interventions from Government officials, has clearly reflected that this law is interpreted as prohibiting all forms of corporal punishment.<\/span><\/li><\/ul><p><span style=\"font-size: 12pt;\">Some concerns have been raised about the 'right of correction' in jurisprudence (judicial decisions) which has not been explicitly repealed in the Law. However, it has been made clear that the intention of the Law is to remove this option for judicial courts: during the November 2018 debates, the Minister for Health, Agn\u00e8s Buzyn, declared that the \u201c<em>inclusion in the Civil Code of the prohibition of corporal punishment<\/em>\u201d was a way to avoid the \u201c<em>sometimes lenient interpretation in judicial decisions<\/em>\u201d related to violence against children (unofficial translation). It was highlighted during the debates that, since the 'right of correction' does not have a basis in legislation, it was inappropriate to repeal it in legislation. In the French civil legal system, the law is higher in the hierarchy of norms than judicial decisions; meaning that this prohibition in the Civil Code should prevent judges from upholding the 'right of correction'. We will continue to monitor decisions to ensure this is applied in practice.<\/span><\/p><p><span style=\"font-size: 12pt;\">The Global Initiative has been able to confirm that the Law applies in at least eight out of France\u2019s eleven overseas territories: French Guiana, Guadeloupe, Martinique, Mayotte, R\u00e9union, St-Barthelemy, St-Martin and the Wallis and Futuna Islands. We are still waiting for confirmation that it also applies in St Pierre et Miquelon. Further work is needed to extend the ban to French Polynesia. The Law does not apply in New Caledonia due to its special status.<br \/>\u00a0<\/span><\/p><\/div><\/div><\/div>\n\n\n<div class=\"row\">\n\t\n\n<div class=\"col-xs-12 col-sm-12\" style=\"background: transparent  \">\n\t<div class=\"text-block shortcode-container\" >\n\t<h4>\u00a0<\/h4><p>&nbsp;<\/p><p><span style=\"font-size: 12pt;\"><em>Mis \u00e0 jour le 23 ao\u00fbt 2019<\/em><\/span><\/p><p>&nbsp;<\/p><h4><strong>La France interdit tous\u00a0les ch\u00e2timents corporels \u00e0 l\u2019encontre des enfants<\/strong><\/h4><p>&nbsp;<\/p><p><span style=\"font-size: 12pt;\">Le 2 juillet 2019, le S\u00e9nat fran\u00e7ais a adopt\u00e9 \u00e0 l\u2019unanimit\u00e9 et sans amendements la proposition de loi qui avait \u00e9t\u00e9 introduite par la d\u00e9put\u00e9e Maud Petit en octobre 2018 et adopt\u00e9e par l\u2019Assembl\u00e9e nationale en novembre 2018.\u00a0L\u2019article 1<sup>er<\/sup> de la loi relative \u00e0 l\u2019interdiction des violences \u00e9ducatives ordinaires modifie l\u2019article 371-1 du Code Civil (addition soulign\u00e9e)\u00a0:<\/span><\/p><blockquote><p><span style=\"font-size: 12pt;\"><em>L'autorit\u00e9 parentale est un ensemble de droits et de devoirs ayant pour finalit\u00e9 l'int\u00e9r\u00eat de l'enfant.<\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em>Elle appartient aux parents jusqu'\u00e0 la majorit\u00e9 ou l'\u00e9mancipation de l'enfant pour le prot\u00e9ger dans sa s\u00e9curit\u00e9, sa sant\u00e9 et sa moralit\u00e9, pour assurer son \u00e9ducation et permettre son d\u00e9veloppement, dans le respect d\u00fb \u00e0 sa personne.<\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em><u>L\u2019autorit\u00e9 parentale s\u2019exerce sans violences physiques ou psychologiques.<\/u><\/em><\/span><\/p><p><span style=\"font-size: 12pt;\"><em>Les parents associent l'enfant aux d\u00e9cisions qui le concernent, selon son \u00e2ge et son degr\u00e9 de maturit\u00e9. \u00bb<\/em><\/span><\/p><\/blockquote><p><span style=\"font-size: 12pt;\">La loi pr\u00e9voit \u00e9galement une formation obligatoire des assistant\u00b7e\u00b7s maternel\u00b7le\u00b7s sur la pr\u00e9vention des ch\u00e2timents corporels (article 2) et fait obligation au gouvernement de produire un rapport d\u2019\u00e9tat des lieux \u00e9valuant les \u00ab\u00a0<em>besoins et moyens n\u00e9cessaires au renforcement de la politique de sensibilisation, d\u2019accompagnement et de soutien \u00e0 la parentalit\u00e9 \u00e0 destination des parents ainsi que de formation des professionnels concern\u00e9s<\/em>\u00a0\u00bb (article 3).\u00a0La Global Initiative se r\u00e9jouit de cette obligation de planification de la mise en \u0153uvre de l\u2019interdiction ainsi que de l\u2019engagement pris par le gouvernement d\u2019inclure cette question dans la strat\u00e9gie nationale sur la protection de l\u2019enfance, qui sera publi\u00e9e plus tard cet \u00e9t\u00e9.<\/span><\/p><p><span style=\"font-size: 12pt;\">La loi va maintenant \u00eatre transmise au pr\u00e9sident pour ratification, qui doit \u00eatre compl\u00e9t\u00e9e sous 15 jours.\u00a0Il faut noter que la loi pourrait toujours \u00eatre renvoy\u00e9e au Conseil constitutionnel pour contr\u00f4le de constitutionalit\u00e9 pendant ce d\u00e9lai de 15 jours, par le Pr\u00e9sident, le Premier Ministre, les pr\u00e9sidents du Senat ou de l\u2019Assembl\u00e9e Nationale ou par un groupe de 60 d\u00e9put\u00e9s ou 60 s\u00e9nateurs. En France, le terme 'violences \u00e9ducatives ordinaires' est plus courant que 'ch\u00e2timents corporels'. D\u2019autres d\u00e9clarations par des membres du Gouvernement lors des d\u00e9bats \u00e0 l\u2019Assembl\u00e9e nationale et au S\u00e9nat ont clairement confirm\u00e9 cette interpr\u00e9tation de la loi.<\/span><\/li><li><span style=\"font-size: 12pt;\">L\u2019expos\u00e9 des motifs de la proposition de loi fait explicitement r\u00e9f\u00e9rence aux ch\u00e2timents corporels et \u00e0 l\u2019obligation de la France de les interdire en vertu des trait\u00e9s internationaux et r\u00e9gionaux des droits humains, aux travaux de recherches effectu\u00e9s sur les effets nocifs des ch\u00e2timents corporels et \u00e0 l\u2019intention d\u2019abolir le 'droit de correction' par cette modification du Code Civil. Le titre de la loi se r\u00e9f\u00e8re en outre \u00e0 \u00ab <em>l\u2019interdiction des violences \u00e9ducatives ordinaires<\/em> \u00bb.<\/span><\/li><li><span style=\"font-size: 12pt;\">Le discours dans le domaine public, y compris les interventions m\u00e9diatiques des repr\u00e9sentants gouvernementaux, refl\u00e8te clairement que cette loi est interpr\u00e9t\u00e9e comme interdisant toutes les formes de ch\u00e2timents corporels.<\/span><\/li><\/ul><p>&nbsp;<\/p><p><span style=\"font-size: 12pt;\">Des inqui\u00e9tudes ont \u00e9t\u00e9 soulev\u00e9es sur le 'droit de correction' jurisprudentiel qui n\u2019a pas \u00e9t\u00e9 explicitement abrog\u00e9 par la loi. Il a toutefois \u00e9t\u00e9 dit clairement que l\u2019intention de la loi est de supprimer cette option pour les juges : lors des d\u00e9bats en novembre 2018, la Ministre de la Sant\u00e9, Agn\u00e8s Buzyn, avait d\u00e9clar\u00e9 que \u00ab <em>l\u2019inscription dans le code civil de l\u2019interdiction des ch\u00e2timents corporels est donc une mani\u00e8re de rompre avec l\u2019appr\u00e9ciation parfois souple de la jurisprudence et une certaine forme d\u2019al\u00e9atoire<\/em> \u00bb. Il a \u00e9galement \u00e9t\u00e9 soulign\u00e9 au cours des d\u00e9bats que, le 'droit de correction' n\u2019ayant pas de base l\u00e9gale, il n\u2019\u00e9tait pas appropri\u00e9 de l\u2019abroger dans la loi. Dans le syst\u00e8me juridique fran\u00e7ais de droit civil, la loi est au-dessus de la jurisprudence dans la hi\u00e9rarchie des normes : cela signifie que cette interdiction dans le Code Civil devrait emp\u00eacher les juges de faire appel au 'droit de correction'. Nous continuerons \u00e0 suivre la situation afin de nous assurer que cela soit appliqu\u00e9 dans la pratique.<\/span><\/p><p><span style=\"font-size: 12pt;\">La Global Initiative est en mesure de confirmer que la loi s\u2019applique dans huit des territoires d\u2019Outre-Mer fran\u00e7ais : la Guyane, la Guadeloupe, la Martinique, Mayotte, R\u00e9union, St-Barth\u00e9lemy, St-Martin et Wallis et Futuna.
