All states have a legal and ethical obligation to prohibit and eliminate all forms of corporal punishment of children.\u00a0<\/strong>Though\u00a0this is\u00a0obvious to us,\u00a0it\u00a0is\u00a0accepted to\u00a0varying degrees worldwide. Some\u00a0states\u00a0are leading the way,\u00a0having\u00a0already enacted prohibition of all corporal punishment and working\u00a0hard to\u00a0implement it\u00a0fully domestically and to promote it globally. Some\u00a0are\u00a0actively working\u00a0towards\u00a0law reform. But\u00a0others\u00a0are\u00a0tacitly or vocally rejecting\u00a0the need for a\u00a0prohibition in legislation\u00a0and children\u2019s right to protection from all corporal punishment.\u00a0\u00a0<\/span><\/p><\/div>\n\n\n\n See which states are leading the way<\/a>\n\n

Among the states which have not yet enacted a ban, the Global Initiative\u00a0monitors\u00a0those which express a commitment to enacting legislation prohibiting all corporal punishment of children, however light, in all settings including the home<\/strong>. In the best cases (such as in\u00a0Nepal\u00a0or\u00a0Georgia), these commitments have become a legal ban. In other cases, commitments made over a decade ago have still not been translated into law reform, or the state later backtracked on its commitment.\u00a0A commitment to fulfilling children's rights must be a pathway to tangible and timely action<\/strong> and we felt it was important to reflect these developments, or lack thereof, in our information.\u00a0\u00a0<\/span><\/p>

Throughout 2019, we conducted an in-depth review of states committed to prohibition of corporal punishment<\/strong>.\u00a0We\u00a0published\u00a0the\u00a0criteria used to confirm states\u2019 commitment<\/a>\u00a0in summer 2019\u00a0and\u00a0called on\u00a0all governments which\u00a0have\u00a0not yet achieved prohibition to publicly commit or reaffirm their commitment to\u00a0law reform. We welcomed input from national human rights institutions, civil society organisations and concerned individuals on\u00a0the issue, and\u00a0consolidated all of this data\u00a0to revise our list of\u00a0committed\u00a0states.\u00a0<\/span><\/p>

We will be publishing the results of our review in the next few days, alongside our new global report.\u00a0Although 2019 was\u00a0a year of great progress in many ways\u00a0\u2013 four states and nine territories enacted a full ban of all corporal punishment \u2013 we can already report that the outcome\u00a0of the commitment review\u00a0has\u00a0seen a sharp drop in the number of states committed to law reform<\/strong>. The review was not an easy task. States sometimes profess commitment to fulfilling human and children\u2019s rights without fully understanding the implications and following through, and isolating genuine commitment was something we could not have achieved without our network of partners.\u00a0This means that several states which\u00a0continue to\u00a0express commitment to law reform (by supporting\u00a0UPR\u00a0recommendations to do so, most often) have lost committed status\u00a0in the updated list, because of their\u00a0lack of action on these commitments. As always, we\u00a0welcome any\u00a0new evidence of commitment\u00a0on those\u00a0and any other states.\u00a0\u00a0<\/span><\/p><\/div>\n\n\n\n See which states are committed to prohibition<\/a>\n\n

It is certainly disappointing to see that fewer states than we thought this time last year truly intend to fulfill children\u2019s right to protection from all forms of violence, including corporal punishment. The progress in recent years has been outstanding but much more work is still to be done throughout the world in challenging the legal, cultural and social acceptance of corporal punishment as normalised violence against a child<\/strong>,\u00a0which\u00a0disregards\u00a0human rights<\/a>, the findings of\u00a0academic research<\/a>\u00a0and\u00a0common sense<\/a>.\u00a0141 states<\/a>\u00a0are yet to enact a full ban of all corporal punishment.\u00a0Law reform<\/a>\u00a0to prohibit its use in all settings, including the home, coupled with\u00a0positive measures<\/a>\u00a0to help parents and teachers understand and adhere to the law, must be\u00a0achieved worldwide.\u00a0\u00a0<\/span><\/p>

But this\u00a0review\u00a0is also an opportunity.\u00a0If we continue at the same rate\u00a0of progress\u00a0that was achieved in the\u00a0past decade,\u00a0we can expect the number of states\u00a0prohibiting all corporal punishment\u00a0to double\u00a0in the next ten years\u00a0\u2013 from\u00a058 to 120\u00a0\u2013\u00a0BUT\u00a0this\u00a0will\u00a0still\u00a0not\u00a0be enough to meet Target 16.2\u00a0by 2030.\u00a0With ten\u00a0years\u00a0left to realise the\u00a0Agenda for Sustainable Development<\/a>,\u00a0states must step up\u00a0and take\u00a0concrete and immediate\u00a0action to protect children from all forms of violence<\/strong>.\u00a0<\/span><\/p>

To do our part, we\u00a0will hold the states committed to law reform accountable to ensure this is achieved. We will keep pushing for other states to\u00a0commit, including through the\u00a0Universal Periodic Review<\/a>, to tackling\u00a0this issue explicitly\u00a0and through law reform.\u00a0We now have\u00a0a clearer picture of the challenge ahead\u00a0and we will not be complacent.<\/strong>\u00a0<\/span><\/p><\/div>\n\t
