{"id":20456,"date":"2021-03-25T12:32:45","date_gmt":"2021-03-25T12:32:45","guid":{"rendered":"https:\/\/endcorporalpunishment.org\/?p=20456"},"modified":"2021-03-25T22:47:13","modified_gmt":"2021-03-25T22:47:13","slug":"republic-of-korea-prohibits-all-corporal-punishment","status":"publish","type":"post","link":"https:\/\/endcorporalpunishment.org\/republic-of-korea-prohibits-all-corporal-punishment\/","title":{"rendered":"Republic of Korea prohibits all corporal punishment of children"},"content":{"rendered":"\n            <div class=\"separator- glacier-section\"  id=\"section-69d7bee806243\">\n            <div class=\"container\">\n                <section>\n                    \n<div class=\"row\">\n\t\n\n<div class=\"col-xs-12 col-sm-6\" style=\"background: transparent  \">\n\t<div class=\"text-block shortcode-container\" style=\"font-size: 16px;\">\n\t<p>With the amendment of the Civil Act 1958 (Act No. 17095) and the repeal of article 915 which gave adults the \u201cright to take disciplinary action\u201d against children, Korea has achieved full prohibition of corporal punishment of children.<\/p><p>Article 915 of the Civil Act (\u201cRight to Take Disciplinary Action\u201d) stated: \u201c<em>The person of parental authority may, in order to protect or educate his or her child, take necessary disciplinary action against the child, and may entrust such child to a reformatory or correctional institution upon the approval of the court<\/em>.\u201d<\/p><p>With the repeal of article 915 of the Civil Act, there is no legal provision that can be interpreted as authorising the use of corporal punishment in childrearing. Article 5(2) the Child Welfare Act which provides that protectors (i.e. parents and other adults with parental authority) shall not \u201cinflict physical pain or psychological pain, including violent language, on the children\u201d (unofficial translation)- <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> therefore applies.<\/p><p>&nbsp;<\/p><p>While announcing the amendment of the Civil Act, the Government<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> stated:<\/p><\/div><\/div>\n\n<div class=\"col-xs-12 col-sm-6\" style=\"background: transparent  \">\n\t<div class=\"feature-box text-center media-box \">\n    <div class=\"fbox-media\">\n                    <img loading=\"lazy\" decoding=\"async\" data-no-retina src=\"https:\/\/endcorporalpunishment.org\/wp-content\/uploads\/2021\/03\/world-day-of-the-prevention-of-child-abuse_petition-scaled-2560x1900.jpg\" alt=\"world day of the prevention of child abuse_petition\" width=\"2560\" height=\"1900\" class=\"img-responsive\" \/>\n        \t<\/div>\n\t<div class=\"fbox-desc\">\n        <h2><\/h2>\n        <span class=\"subtitle\">A petition against corporal punishment presented on the World Day of the Prevention of Child Abuse.<\/span>\n        \n    <\/div>\n<\/div><\/div><\/div>\n\n\n<div class=\"row\">\n\t\n\n<div class=\"col-xs-12 col-sm-12\" style=\"background: transparent  \">\n\t<div class=\"text-block shortcode-container\" style=\"font-size: 16px;\">\n\t<blockquote><h3>\u201c<em>A ban on the corporal punishment of children by their parents is the most fundamental stipulation in preventing child abuse\u2026<\/em><em> the passage of the legislative amendment through the National Assembly is expected to provide an opportunity to fundamentally improve the social awareness towards the corporal punishment of children and child abuse<\/em>\u201d.<\/h3><\/blockquote><p>This law reform is the culmination of collaborative work between the Government of the Republic of Korea and its child rights partners. The campaign to prohibit corporal punishment was spearheaded by Save the Children Korea through its \u201cChange 915: No one deserves to be hit\u201d Campaign, launched in May 2019. In January 2021, the Government announced that a promotion campaign for raising awareness about prohibition of corporal punishment had been included in the \u201cComplements of the Child Abuse Preventive System\u201d.<\/p><p>We congratulate the Government of the Republic of Korea and all partners, and warmly welcome the amendment of the Civil Act and the measures taken by the Government to support implementation of prohibition.<\/p><p><strong>With this law reform, Korea becomes the 62<sup>nd<\/sup> state worldwide, and the fourth in the Asia Pacific region, to realise children\u2019s rights to protection from all corporal punishment.<\/strong><\/p><p>With a child population of 9 million, prohibition in the Republic of Korea brings the total number of children worldwide protected by law from corporal punishment to 300 million.
